Child Sexual Assault

The defendant was charged with two counts of continuous sexual abuse of a child. The Defendant’s 5 and 7 year old daughters told the SART team, police and the jury that the Defendant sexually assaulted them multiple times while alone. A SART nurse testified that sexual assault exam on the 5 year old was consistent with having been sexually assaulted. The defense called a medical doctor with expertise in physical signs of child sexual abuse and investigation of sexual abuse allegations, as well as a child suggestibility expert as part of arguing that the allegations were the product of a bitter break-up between the Defendant and children’s mother and that the 5 year old showed no signs of having been sexually abused. The jury hung 9-3 for not guilty and the defendant later accepted a misdemeanor plea.
