Robbery and Assault
Defendant was drunk and walking through the parking lot of a Target store. He came across victim who was putting her belongings in her car. Defendant simulated a weapon and demanded the victim’s purse. An eyewitness intervened and yelled at defendant, who ran away. He was caught by parking lot security and held for police.
Defendant was charged with Attempted Robbery.
Defendant had been sober for ten years and fell off the wagon when he was laid off from work. Being in his fifties he was depressed about not having job, and not having many prospects. Rich took this information to the DA and convinced her that this was an anomaly for defendant and not likely to recur. After bringing evidence of defendant’s renewed sobriety and commitment to it, Rich was able to negotiate probation and work furlough.
