Felony DUI With Injury

Defendant had fallen off the wagon and began drinking again. One day he was driving home when he rear-ended a car which was pushed into several other cars. Multiple injuries occurred as a result of the collision which included children. Defendant’s blood alcohol level was a point 22, almost three times the legal limit.

The DA was insisting on prison time, but Rich negotiated a “lid” offer which made probation a possibility if we could convince the judge that it was appropriate. Defendant was a Marine Biologist who was very successful and published. The defense put together a 200 page sentencing memorandum which included a biography of the Defendant, his published articles and discoveries. The judge agreed prison was not appropriate and imposed probation. Further, the judge agreed to no local jail time, provided the Defendant used his knowledge and expertise to educate children. Defendant followed through and avoided jail.
