Assault With A Deadly Weapon
Defendant worked with victim at a restaurant. The victim was a terrible employee but would blame defendant when management inquired as to the shoddy work. One day Defendant had enough of the victim’s lies and poor work ethic and said something to him. Victim responded with an insult. Infuriated, the defendant grabbed a large butcher knife from the kitchen and backed the victim up against a wall. With the knife in hand, the defendant threatened to kill victim.
Defendant was charged with a Strike – Assault with a Deadly Weapon.
Defense investigation determined victim was somewhat of a bully at work and not trustworthy. Additionally, a non-English speaking co-worker witnessed the incident, and contradicted victim’s version of events. Rich was able to convince the DA to dismiss the felony strike and negotiated misdemeanor Disturbing the Peace with no jail time.
