Rape

The client was charged with three counts of rape by foreign object, oral copulation of a person under 18, four counts of lewd acts upon a child and contributing to the delinquency of a minor for allegedly having a sexual relationship with three separate underage girls and buying alcohol and cigarettes for them to facilitate the relationships. When interviewed by police, the client gave a videotaped confession to all three relationships.

After retaining psychologists to evaluate the client, Mr. Sweigart was able to convince the prosecution that the client was actually younger mentally than the victims and that state prison would be inappropriate even though there were multiple victims. Sweigart was able to negotiate a county jail sentence of less than one year.
